This page sets out the terms of use and disclaimer of liability (hereinafter together referred to as the “Disclaimer”) of Kaiser Partner Holding Anstalt, Liechtenstein, and all affiliated entities, including its subsidiaries (hereinafter collectively referred to as “Kaiser Partner”).

By accessing the website, social media profiles, e-banking application, mobile apps, or other applications of Kaiser Partner (hereinafter collectively referred to as “KP Digital Services”), you acknowledge the content and agree that the terms of this Disclaimer are legally binding. Please read this Disclaimer carefully. If you do not agree with this Disclaimer, or any of the terms set out herein, you are not permitted to access any other pages of KP Digital Services.

Kaiser Partner is authorized to change this Disclaimer and any other information and data available through KP Digital Services without notice.

2. Access and Restrictions on Use

KP Digital Services and the content provided therein are not intended for persons resident in any jurisdictions where the distribution of such information and data is prohibited by law or where prior registration, approval, or authorization has not been obtained by Kaiser Partner and is required.

Furthermore, under certain circumstances, persons resident or entities based in certain countries, or certain categories of person, may neither use or purchase products or financial services published on KP Digital Services.

3. No Offer

The material provided on KP Digital Services is intended for information purposes only. Such information must not be construed as any form of promotion, recommendation, offer or solicitation to buy or sell financial instruments, transact any business, use financial services, or enter into any other legal transactions. Moreover, such information does not constitute, nor is it intended to provide or be construed as any form of legal, tax, financial, or other advice.

Kaiser Partner makes no representation or warranty, whether express or implied, that any information, data, opinions, and other content published on KP Digital Services are current, correct, complete, or accurate.

Without limiting the generality of the foregoing, Kaiser Partner makes no warranty as to the completeness, accuracy, timeliness, reliability, or availability of KP Digital Services or any results that may be obtained from using KP Digital Services. Neither does Kaiser Partner make any warranty that KP Digital Services will be free of viruses or errors.

5. No Liability

Neither Kaiser Partner nor its executive officers, employees, or agents are liable for any direct or indirect loss, costs, liability or other claims, consequential loss or any other loss or damage, of whatever nature, that may result or be caused through the use of KP Digital Services, whether arising in contract, tort, or otherwise, to the extent that such liability may be excluded by law. The foregoing also applies, in particular, to loss or damage resulting from negligence.

6. Intellectual Property

Kaiser Partner, or the relevant rights holder, own and retain all rights, interest, and title (including all copyright, trademarks, and patents) in, to, and arising from all data, information, and content available on KP Digital Services.

Individual pages or sections of KP Digital Services may only be used or printed out for private purposes, having regard to copyright and other intellectual property notices. No pages, sections of pages, texts, images, clips, or databases, etc., may be processed, this means in particular copied, presented, reproduced, duplicated, distributed, published, or otherwise used for professional, commercial, or public purposes, without the express prior consent of Kaiser Partner.

7. Links

KP Digital Services may contain links to third-party websites, mobile apps, etc., or content provided by third parties. Kaiser Partner has no control over such websites, mobile apps, or content and accepts no responsibility or warranty in respect thereof. Kaiser Partner makes no representation or warranty as to the quality, accuracy, currency, or reliability of such websites, mobile apps, and content and, accordingly, cannot be held liable in respect thereof.

8. Data Protection

Kaiser Partner complies with data protection requirements within its sphere of control. However, Kaiser Partner draws your attention to the fact that universally accessible media, such as KP Digital Services, may not be fully protected or confidential even if appropriate technical and organizational measures have been implemented. Where a computer, mobile phone, or other device is used to transfer information online, personal information may, owing to the inherent design of the Internet, inadvertently be transferred to other countries, even if the sender and recipient are located in the same country. In addition, it cannot be excluded that third parties may also gain access to such data and infer, on this basis, that a business relationship exists between you and Kaiser Partner.

Kaiser Partner recommends that particularly sensitive information and data, including, but not limited to, personal data and account data, should only be sent through secure communication channels. If you enter and/or transfer personal or business information through KP Digital Services, you acknowledge that you are doing so voluntarily, are fully aware of the associated risks, and are willing to accept that the information will not be secure.

Kaiser Partner disclaims all liability for any loss or damage, including consequential loss, that may be suffered due to use of KP Digital Services (see also clause 5).

9. Collection of Data

Kaiser Partner may collect data or data tracks entered or logged by you, whether actively or passively, when visiting or using KP Digital Services. Any data collected will be stored on secure servers either within or outside Liechtenstein.

In general, any data collected on you will only be shared between or accessible to Kaiser Partner entities and their cooperation partners, and/or appointed third parties. Kaiser Partner is also permitted to provide access to or disclose the data collected to competent courts, authorities, or other bodies in compliance with any legal or regulatory requirement.

We will analyze your visits to KP Digital Services. We will perform such analysis ourselves or use the expertise, tools, or analytical services of third parties, either within or outside Liechtenstein (e.g. Google Analytics). Cookies may be used for the purpose of analyzing your use of KP Digital Services. Cookies are text files that are stored on your computer. Cookies may be used to record details of your use of KP Digital Services, for example your IP address, the website from which you visit us, the browser you use, and the specific pages of KP Digital Services accessed by you, including the date and duration of your visit. In addition, we will collect personal data (such as name, sex, address, e-mail address, telephone or fax number) that you provide to us through KP Digital Services, for example when you input information into a login page, or register for an e-mail newsletter.

Kaiser Partner will only use data recorded through your use of KP Digital Services, any analytical reports generated, and your personal data specifically for the purposes of:

  • technical management, research, and making enhancements to KP Digital Services;
  • client and user administration and marketing;
  • informing you of our products and services; and
  • any other purposes specified.

Kaiser Partner shall comply with applicable legislation and rules on the use of personal data.

By using KP Digital Services, you expressly agree to the processing of any personal data collected by Kaiser Partner, or as described above, and release Kaiser Partner from its obligations of confidentiality. Processing includes any action performed in respect of data, including, but not limited to, obtaining, retaining, using, altering, disclosing, archiving, or destroying data.

Kaiser Partner is not liable for any loss or damage, including consequential loss, that may result from the collection of data (see also clause 5).

10. Severability

If specific provisions or parts of this Disclaimer are or become invalid, unlawful, void, or unenforceable under any legal system that may apply, such provisions or parts will not affect the validity of the remaining provisions hereof.

11. Applicable Law and Place of Jurisdiction

Any disputes arising out of or in connection with the use of KP Digital Services and this Disclaimer are governed by and construed exclusively in accordance with Liechtenstein law. Vaduz, Liechtenstein, is the exclusive place of jurisdiction.
